In Virginia, parents have a duty to provide financial support for their children. The amount of child support depends on each parents’ income in relation to the number of overnights spent with each parent.

Sole Custody Guideline: When a child spends 90 or fewer nights per year with the “non custodial” parent a sole custody guideline is used to determine the child support amount. A sole custody guideline for child support does not change the status of legal custody.

Virginia Code Section 20-108.2 provides a guideline chart to assist in determining the amount of child support needed. The number of overnights spent with each parent will be used to determine which guideline calculation to use.
